Akti i Diskriminimit t\u00eb Shtatz\u00ebnis\u00eb (PDA) ndalon diskriminimin n\u00eb baz\u00eb t\u00eb shtatz\u00ebnis\u00eb kur b\u00ebhet fjal\u00eb p\u00ebr \u00e7do aspekt t\u00eb pun\u00ebsimit, duke p\u00ebrfshir\u00eb pun\u00ebsimin, shkarkimin, pag\u00ebn, detyrat e pun\u00ebs, promovimet, pushimin nga puna, trajnimin, p\u00ebrfitimet an\u00ebsore, t\u00eb tilla si pushimi dhe sigurimi sh\u00ebndet\u00ebsor etj.<\/p>\n\n\n\n<p>Diskriminimi i shtatz\u00ebnis\u00eb p\u00ebrfshin gjithashtu paragjykimet e perceptuara kur punonj\u00ebsit n\u00eb pritje p\u00ebrjetojn\u00eb sjellje delikate armiq\u00ebsore si izolimi social, stereotipet negative dhe trajtimi nd\u00ebrpersonal negativ ose i vrazhd\u00eb, si pritshm\u00ebrit\u00eb m\u00eb t\u00eb ul\u00ebta mbi performanc\u00ebn e tyre, transferimi i punonj\u00ebses shtatz\u00ebn\u00eb n\u00eb nd\u00ebrrime ose detyra m\u00eb pak t\u00eb d\u00ebshirueshme ose shaka t\u00eb pap\u00ebrshtatshme dhe komente nd\u00ebrhyr\u00ebse.<\/p>\n\n\n\n<p>Pavar\u00ebsisht ligjeve q\u00eb synojn\u00eb t&#8217;i japin fund diskriminimit t\u00eb grave shtatz\u00ebna n\u00eb vendet e pun\u00ebs, mij\u00ebra prej tyre p\u00ebrballen \u00e7do vit me diskriminimin nga pun\u00ebdh\u00ebn\u00ebsit lidhur me shtatz\u00ebnit\u00eb e tyre. Ky \u00ebsht\u00eb nj\u00eb realitet p\u00ebr t\u00eb gjitha grat\u00eb, t\u00eb profesioneve t\u00eb ndryshme; profesioneve me paga t\u00eb ul\u00ebta, profesione me paga t\u00eb larta dhe madje edhe vende pune t\u00eb dedikuara p\u00ebr t\u00eb mb\u00ebshtetur grat\u00eb.<\/p>\n\n\n\n<p>Diskriminimi ndaj pun\u00ebtoreve shtatz\u00ebna ka qen\u00eb i paligjsh\u00ebm q\u00eb nga miratimi i Ligjit p\u00ebr Diskriminimin e Shtatz\u00ebnis\u00eb (PDA) n\u00eb vitin 1978. PDA e ndaloi zyrtarisht diskriminimin e pun\u00ebdh\u00ebn\u00ebsit n\u00eb baz\u00eb t\u00eb shtatz\u00ebnis\u00eb duke e kategorizuar n\u00eb m\u00ebnyr\u00eb eksplicite diskriminimin e shtatz\u00ebnis\u00eb si diskriminim gjinor sipas Titullit VII t\u00eb Aktit t\u00eb t\u00eb Drejtave Civile t\u00eb vitit 1964. Megjith\u00ebse PDA ka ndihmuar m\u00eb shum\u00eb gra q\u00eb t\u00eb vazhdojn\u00eb t\u00eb punojn\u00eb gjat\u00eb shtatz\u00ebnis\u00eb, hulumtimet kan\u00eb gjetur se grat\u00eb ende vazhdojn\u00eb t\u00eb p\u00ebrballen me diskriminimin nga pun\u00ebdh\u00ebn\u00ebsit n\u00eb lidhje me shtatz\u00ebnit\u00eb e tyre.<\/p>\n\n\n\n<p>Pjesa m\u00eb e madhe e k\u00ebtij hulumtimi fokusohet n\u00eb rastet gjyq\u00ebsore. \u00c7\u00ebshtjet gjyq\u00ebsore jan\u00eb t\u00eb r\u00ebnd\u00ebsishme p\u00ebr sqarimin e interpretimit t\u00eb ligjeve nga gjykatat dhe sigurimin e precedentit, megjithat\u00eb, meqen\u00ebse vet\u00ebm nj\u00eb pakic\u00eb e vog\u00ebl e akuzave p\u00ebr diskriminim t\u00eb pun\u00ebdh\u00ebn\u00ebsve shkojn\u00eb n\u00eb gjykat\u00eb, shqyrtimi i \u00e7\u00ebshtjeve gjyq\u00ebsore nuk ofron nj\u00eb kuptim t\u00eb plot\u00eb t\u00eb shkall\u00ebs s\u00eb diskriminimit t\u00eb shtatz\u00ebnis\u00eb dhe mjeteve juridike t\u00eb disponueshme p\u00ebr ato q\u00eb ngren\u00eb padi kund\u00ebr pun\u00ebdh\u00ebn\u00ebsit t\u00eb tyre. Raporti yn\u00eb ofron nj\u00eb kuptim m\u00eb t\u00eb gjer\u00eb t\u00eb diskriminimit t\u00eb shtatz\u00ebnis\u00eb n\u00eb vendin e pun\u00ebs duke analizuar t\u00eb gjitha 26,650 akuzat p\u00ebr diskriminim t\u00eb shtatz\u00ebnis\u00eb t\u00eb paraqitura n\u00eb Komisionin e ShBA-s\u00eb p\u00ebr Mund\u00ebsi t\u00eb Barabarta p\u00ebr Pun\u00ebsim (EEOC) dhe Agjencit\u00eb Shtet\u00ebrore t\u00eb Praktikave t\u00eb Drejta t\u00eb Pun\u00ebsimit (FEPA) midis 2012 dhe 2016.<\/p>\n\n\n\n<p>T\u00eb gjeturat kryesore t\u00eb k\u00ebtij hulumtimi deklarojn\u00eb se:<\/p>\n\n\n\n<p>Diskriminimi i shtatz\u00ebnis\u00eb \u00ebsht\u00eb nj\u00eb form\u00eb unike e diskriminimit gjinor. Krahasuar me format e tjera t\u00eb diskriminimit, diskriminimi i shtatz\u00ebnis\u00eb ndodh shum\u00eb m\u00eb shpesh dhe shpejt&nbsp; \u2013 kur pun\u00ebdh\u00ebn\u00ebsit diskriminues m\u00ebsojn\u00eb se nj\u00eb punonj\u00ebse \u00ebsht\u00eb shtatz\u00ebn\u00eb, ajo pushohet nga puna, shpesh n\u00eb t\u00eb nj\u00ebjt\u00ebn dit\u00eb q\u00eb kuptojn\u00eb se ajo \u00ebsht\u00eb shtatz\u00ebne.<\/p>\n\n\n\n<p>Shkalla e diskriminimit t\u00eb shtatz\u00ebnis\u00eb duket t\u00eb jet\u00eb m\u00eb e lart\u00eb n\u00eb industrit\u00eb e dominuara nga burrat. T\u00eb kesh m\u00eb shum\u00eb menaxhere gra duket se zvog\u00eblon gjasat e diskriminimit t\u00eb shtatz\u00ebnis\u00eb n\u00eb nj\u00eb vend pune. Institucionet q\u00eb jan\u00eb akuzuar me diskriminim t\u00eb shtatz\u00ebnis\u00eb priren t\u00eb ken\u00eb m\u00eb shum\u00eb udh\u00ebheq\u00ebs burra.<\/p>\n\n\n\n<p>Pretendimet e diskriminimit t\u00eb shtatz\u00ebnis\u00eb k\u00ebrkojn\u00eb mesatarisht 280 dit\u00eb p\u00ebr t&#8217;u zgjidhur brenda sistemit t\u00eb p\u00ebrpunimit t\u00eb rasteve t\u00eb EEOC. Meqen\u00ebse nj\u00eb shtatz\u00ebni normale zgjat af\u00ebrsisht t\u00eb nj\u00ebjt\u00ebn koh\u00eb dhe ka t\u00eb ngjar\u00eb q\u00eb grat\u00eb t\u00eb mos e zbulojn\u00eb shtatz\u00ebnin\u00eb e tyre n\u00eb tremujorin e par\u00eb, sistemi i padis\u00eb nuk \u00ebsht\u00eb i dizajnuar mir\u00eb p\u00ebr t\u00eb parandaluar ose korrigjuar diskriminimin e shtatz\u00ebnis\u00eb.<\/p>\n\n\n\n<p><strong>Sa <strong>\u00ebsht\u00eb<\/strong> i p\u00ebrhapur diskriminimi i shtatz\u00ebnis\u00eb?<\/strong><\/p>\n\n\n\n<p>Vler\u00ebsimi i prevalenc\u00ebs komb\u00ebtare t\u00eb diskriminimit t\u00eb shtatz\u00ebnis\u00eb \u00ebsht\u00eb i v\u00ebshtir\u00eb duke pasur parasysh munges\u00ebn e t\u00eb dh\u00ebnave p\u00ebr p\u00ebrvojat e pun\u00ebs s\u00eb grave shtatz\u00ebna. Megjithat\u00eb, t\u00eb kuptuarit e p\u00ebrvojave n\u00eb vendin e pun\u00ebs t\u00eb n\u00ebnave n\u00eb pritje \u00ebsht\u00eb thelb\u00ebsore duke pasur parasysh rritjen e tyre n\u00eb fuqin\u00eb pun\u00ebtore. Sipas nj\u00eb Raporti t\u00eb Censusit t\u00eb vitit 2011, gjasat q\u00eb nj\u00eb grua n\u00eb SHBA t\u00eb punonte gjat\u00eb shtatz\u00ebnis\u00eb u rrit ndjesh\u00ebm gjat\u00eb viteve 1960-70. N\u00eb fillim t\u00eb viteve 1960 rreth 45% e grave punonin gjat\u00eb shtatz\u00ebnive t\u00eb tyre t\u00eb para. Nd\u00ebrsa sot, gati 70% e grave punojn\u00eb gjat\u00eb shtatz\u00ebnis\u00eb s\u00eb tyre.<\/p>\n\n\n\n<p>Pavar\u00ebsisht rritjes s\u00eb numrit t\u00eb grave q\u00eb punojn\u00eb gjat\u00eb shtatz\u00ebnis\u00eb s\u00eb tyre, n\u00ebnat n\u00eb pritje vazhdojn\u00eb t\u00eb p\u00ebrballen me sfida n\u00eb vendin e pun\u00ebs. P\u00ebrderisa shum\u00eb gra mund t\u00eb vazhdojn\u00eb t\u00eb punojn\u00eb gjat\u00eb shtatz\u00ebnis\u00eb pa ndonj\u00eb rregullim n\u00eb pun\u00ebn e tyre, nj\u00eb studim i koh\u00ebve t\u00eb fundit nga Childbirth Connection, nj\u00eb iniciativ\u00eb e fokusuar n\u00eb kujdesin e maternitetit, zbuloi se shumica e grave q\u00eb punonin gjat\u00eb shtatz\u00ebnis\u00eb kishin nevoj\u00eb p\u00ebr nj\u00eb lloj akomodimi t\u00eb ve\u00e7ant\u00eb n\u00eb vendin e pun\u00ebs n\u00eb lidhje me shtatz\u00ebnin\u00eb e tyre. Shpesh, k\u00ebto akomodime jan\u00eb k\u00ebrkesa t\u00eb vogla; shumica (71%) e grave raportuan q\u00eb k\u00ebrkonin pushime m\u00eb t\u00eb shpeshta, t\u00eb tilla si pushime shtes\u00eb n\u00eb banj\u00eb. P\u00ebraf\u00ebrsisht 5,300 akuza p\u00ebr diskriminimin e shtatz\u00ebnis\u00eb paraqiten \u00e7do vit, duke sugjeruar se vet\u00ebm rreth 2% e rasteve t\u00eb diskriminimit t\u00eb shtatz\u00ebnis\u00eb jan\u00eb paraqitur n\u00eb EEOC federale ose FEPA shtet\u00ebrore.<\/p>\n\n\n\n<p><strong>Kush i paraqet akuzat p\u00ebr diskriminim t\u00eb shtatz\u00ebnis\u00eb?<\/strong><\/p>\n\n\n\n<p>Duke p\u00ebrdorur t\u00eb dh\u00ebnat e akuzave p\u00ebr diskriminimin e pun\u00ebdh\u00ebn\u00ebsve t\u00eb paraqitura n\u00eb EEOC ose FEPA shtet\u00ebrore midis 2012 dhe 2016, p\u00ebrshkruhen edhe racat e grave q\u00eb kan\u00eb paraqitur akuza p\u00ebr diskriminim shtatz\u00ebnie.<\/p>\n\n\n\n<p>N\u00eb lidhje me akuzat e tjera p\u00ebr diskriminim t\u00eb bazuar n\u00eb seks, akuzat p\u00ebr diskriminim t\u00eb shtatz\u00ebnis\u00eb jan\u00eb m\u00eb t\u00eb zakonshme tek grat\u00eb e bardha dhe m\u00eb pak t\u00eb zakonshme tek grat\u00eb e zeza.
