Kjo lloj dhun\u00eb ndodh\u00eb n\u00eb kuad\u00ebr t\u00eb nj\u00eb marr\u00ebdh\u00ebnie familjare ose intime dhe synon t\u00eb ushtroj\u00eb kontroll mbi viktim\u00ebn<a href=\"#_ftn1\" id=\"_ftnref1\">[1]<\/a> (WHO, 2018). Ushtrimi i dhun\u00ebs se till\u00eb cenon tri t\u00eb drejta themelore t\u00eb njeriut:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>E drejta p\u00ebr jet\u00eb dhe siguri t\u00eb personit, Neni 3 Deklarata Universale p\u00ebr t\u00eb Drejta t\u00eb njeriut (DUDNJ), Neni 6 dhe Neni 9 Pakti Nd\u00ebrkomb\u00ebtar p\u00ebr t\u00eb drejta Civile dhe Politike (ICCPR)<\/li>\n\n\n\n<li>E drejta p\u00ebr barazi nga Konventa p\u00ebr Eliminimin e t\u00eb gjitha Formave t\u00eb Diskriminimit ndaj Gruas (CEDAW) si dhe<\/li>\n\n\n\n<li>Ndalimi i tortur\u00ebs (CAT).<a id=\"_ftnref2\" href=\"#_ftn2\">[2]<\/a><\/li>\n<\/ol>\n\n\n\n<p>Republika e Kosov\u00ebs nuk b\u00ebn p\u00ebrjashtim n\u00eb problemin rajonal t\u00eb rritjes s\u00eb dhun\u00ebs n\u00eb familje dhe dhun\u00ebs me baz\u00eb gjinore. Kodi Penal i Republik\u00ebs definon si vep\u00ebr t\u00eb penale dhun\u00ebn n\u00eb familje dhe at\u00eb n\u00eb \u00e7far\u00ebdo forme abuzimi, qoft\u00eb fizike, psikologjike, ekonomike apo seksuale q\u00eb ndodh\u00eb brenda nj\u00eb marr\u00ebdh\u00ebnie familjare (RKS, 2022) . \u201cDispozitat q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me mbrojtjen nga dhuna n\u00eb familje n\u00eb Kosov\u00eb jan\u00eb parapar\u00eb me Kodin Penal, ligjin p\u00ebr mbrojtje nga dhuna n\u00eb familje, Kodin e Procedur\u00ebs Penale, Kodin e Drejt\u00ebsis\u00eb p\u00ebr t\u00eb Miturit dhe ligjin p\u00ebr ekzekutimin e sanksioneve penale\u201d<a href=\"#_ftn3\" id=\"_ftnref3\">[3]<\/a> (OSBE, 2018). P\u00ebr m\u00eb tep\u00ebr, Projekti i Strategjis\u00eb Komb\u00ebtare t\u00eb Republik\u00ebs s\u00eb Kosov\u00ebs p\u00ebr Mbrojtje nga Dhuna n\u00eb Familje dhe Dhuna ndaj Grave 2022 &#8211; 2026, s\u00eb bashku me Planin e saj t\u00eb Veprimit, paraqet nj\u00eb nga p\u00ebrpjekjet m\u00eb t\u00eb detajuara dhe t\u00eb p\u00ebrmbledhura p\u00ebr t\u00eb adresuar fenomenin e dhun\u00ebs n\u00eb familje dhe dhun\u00ebs ndaj grave n\u00eb Kosov\u00eb (RKS, 2022). Studimi i fenomenit t\u00eb dhun\u00ebs n\u00eb familje tregon shpeshher\u00eb nd\u00ebrlidhjen e dhun\u00ebs n\u00eb familje me dhun\u00ebn me baz\u00eb gjinore p\u00ebr shkak t\u00eb nd\u00ebrthurjes s\u00eb konsiderueshme midis k\u00ebtyre dy fenomeneve. N\u00eb k\u00ebt\u00eb rast do shqyrtojm\u00eb vet\u00ebm dhun\u00ebn n\u00eb familje, mir\u00ebpo nuk duhet t\u00eb anashkalohet ngjashm\u00ebria evidente e cila lidhet me gjinin\u00eb e viktimave. N\u00eb Kosov\u00eb besohet q\u00eb mbi 80% t\u00eb viktimave jan\u00eb gra (QIKA, 2023).<\/p>\n\n\n\n<p>N\u00eb k\u00ebt\u00eb artikull do t\u00eb thellohemi n\u00eb statistikat dhe trendet e rasteve t\u00eb dhun\u00ebs n\u00eb familje, t\u00eb raportuara n\u00eb Kosov\u00eb nga viti 2016 deri n\u00eb vitin 2022, e dokumentuar n\u00eb prokurorit\u00eb e Republik\u00ebs se Kosov\u00ebs. Duke dokumentuar dhe analizuar k\u00ebto t\u00eb dh\u00ebna, ne synojm\u00eb t\u00eb nxisim nj\u00eb debat shoq\u00ebror dhe rrjedhimisht t\u00eb identifikohen mund\u00ebsit\u00eb p\u00ebr t\u00eb parandaluar rritjen e m\u00ebtutjeshme t\u00eb dhun\u00ebs n\u00eb familje dhe dhun\u00ebs me baz\u00eb gjinore n\u00eb rajon. Gjat\u00eb analizimit t\u00eb k\u00ebtyre t\u00eb dh\u00ebnave \u00ebsht\u00eb thelb\u00ebsore t\u00eb mirret parasysh se pas k\u00ebtyre numrave q\u00ebndrojn\u00eb njer\u00ebz real, fatet e t\u00eb cil\u00ebve jan\u00eb prekur nga problemi strukturor i dhun\u00ebs. N\u00ebp\u00ebrmjet nj\u00eb analize rigoroze t\u00eb t\u00eb dh\u00ebnave t\u00eb disponueshme dhe kuantitfikimit t\u00eb problemit, synojm\u00eb t\u00eb kuptojm\u00eb thell\u00ebsin\u00eb e tij dhe t\u00eb krijom\u00eb kanale q\u00eb mund\u00ebsojn\u00eb qasje m\u00eb t\u00eb leht\u00eb n\u00eb informata dhe t\u00eb dh\u00ebna. Kjo e fundit mund t\u00eb sh\u00ebrbej\u00eb si baz\u00eb p\u00ebr hulumtimet e ardhshme, me shpres\u00eb edhe baz\u00eb e zgjidhjeve t\u00eb problemit.<\/p>\n\n\n\n<p>P\u00ebr m\u00eb tep\u00ebr, ne do t\u00eb shqyrtojm\u00eb faktor\u00ebt q\u00eb kontribuojn\u00eb n\u00eb vazhdim\u00ebsin\u00eb e k\u00ebsaj dhune brenda kontekstit shoq\u00ebror, kulturor dhe ligjor t\u00eb Kosov\u00ebs. Kuptimi i k\u00ebtyre dinamikave komplekse \u00ebsht\u00eb thelb\u00ebsor p\u00ebr hartimin e strategjive dhe mekanizmave efektiv\u00eb. P\u00ebrmes njohurive dhe informimit, nd\u00ebrgjegj\u00ebsimit dhe p\u00ebrpjekjeve kolektive, ne shpresojm\u00eb t\u00eb kontribuojm\u00eb q\u00eb n\u00eb nj\u00eb t\u00eb ardhme, statistikat q\u00eb shqyrtojm\u00eb sot, t\u00eb z\u00ebvend\u00ebsohen me tregime p\u00ebr fuqizimin e t\u00eb gjith\u00eb atyre q\u00eb jan\u00eb prekur nga dhuna n\u00eb familje dhe n\u00eb baz\u00eb gjinore. &nbsp;Kemi nevoj\u00eb p\u00ebr analiza q\u00eb g\u00ebrmojn\u00eb m\u00eb thell\u00eb n\u00eb t\u00eb dh\u00ebna q\u00eb jan\u00eb t\u00eb ndara sipas gjinis\u00eb, por edhe marrin parasysh tregues specifik\u00eb t\u00eb kontekstit. Dallimet n\u00eb rastet dhe raportimet e rasteve jan\u00eb thelb\u00ebsore p\u00ebr t&#8217;u analizuar n\u00eb kombinim me indikator\u00ebt specifik\u00eb shpjegues. Kuptimi i k\u00ebtyre variacioneve nevojitet p\u00ebr dizajnimin e politikave dhe nd\u00ebrhyrjeve q\u00eb synojn\u00eb p\u00ebrmir\u00ebsimin e k\u00ebtyre problemeve. N\u00eb munges\u00eb t\u00eb t\u00eb dh\u00ebnave q\u00eb marrin parasysh treguesit specifik\u00eb rajonal, ashtu edhe t\u00eb dh\u00ebnat e ndara sipas gjinis\u00eb, shpjegimet e mundshme jan\u00eb nj\u00eb grumbullim nga t\u00eb dh\u00ebnat sekondare t\u00eb disponueshme. N\u00eb p\u00ebrgjith\u00ebsi, \u00ebsht\u00eb e r\u00ebnd\u00ebsishmt t\u00eb p\u00ebrmendet se k\u00ebta faktor\u00eb, edhe pse lidhen me rritjen ose uljen e dhun\u00ebs n\u00eb familje n\u00eb nj\u00eb rajon, mund t\u00eb analizohen me sukses vet\u00ebm n\u00eb t\u00ebr\u00ebsi me t\u00eb dh\u00ebna shtes\u00eb dhe teori p\u00ebrkat\u00ebse dhe nuk n\u00ebnkuptojn\u00eb kauzalitet.<\/p>\n\n\n\n<p><strong>Statistikat p\u00ebr personat me kall\u00ebzime penale p\u00ebr dhun\u00ebn n\u00eb familje gjat\u00eb viteve 2016-2022<\/strong><\/p>\n\n\n\n<p>T\u00eb dh\u00ebnat tregojn\u00eb nj\u00eb trajektore shqet\u00ebsuese p\u00ebr rastet e dhun\u00ebs n\u00eb familje gjat\u00eb viteve 2016 deri m\u00eb 2022. N\u00eb vitin 2016, pati 5,472 persona me kall\u00ebzime penale, nd\u00ebrsa n\u00eb vitin 2017 dhe 2018 v\u00ebrehet num\u00ebr m\u00eb i vog\u00ebl i l\u00ebnd\u00ebve n\u00eb pun\u00eb p\u00ebr personat me kall\u00ebzime penale. N\u00eb vitin 2019 v\u00ebrehet p\u00ebrs\u00ebri rritje e l\u00ebnd\u00ebve n\u00eb pun\u00eb q\u00eb trajton\u00eb kall\u00ebzimet penale p\u00ebr dhun\u00ebn n\u00eb familje. &nbsp;N\u00eb total gjat\u00eb viteve 2016-2022 n\u00eb Prokurorit\u00eb e Kosov\u00ebs kan\u00eb qen\u00eb gjithsej 20,728 persona me kall\u00ebzime penale.<\/p>\n\n\n\n<p>Besohet se n\u00eb vitet pandemike, ka pasur rritje globale t\u00eb rasteve t\u00eb dhun\u00ebs n\u00eb familje, gj\u00eb q\u00eb i atribuohet masave q\u00eb shkaktuan rritje t\u00eb presionit emocional, izolimit shoq\u00ebror dhe abuzimit me substanca q\u00eb besohet q\u00eb jan\u00eb t\u00eb lidhura me dhun\u00ebn n\u00eb familje (The American Journal of Emergency Medicine, 2022). Shum\u00eb faktor\u00eb mund t\u00eb kontribuojn\u00eb n\u00eb k\u00ebto dallime. Normat e raportimit mund t\u00eb ndryshojn\u00eb midis zonave urbane dhe rurale p\u00ebr shkak t\u00eb dallimeve n\u00eb aksesin n\u00eb sh\u00ebrbimet mb\u00ebshtet\u00ebse, pranis\u00eb s\u00eb zbatuesve t\u00eb ligjit dhe faktor\u00ebve kulturor\u00eb. Zonat rurale mund t\u00eb ken\u00eb m\u00eb pak akses n\u00eb burime dhe t\u00eb jen\u00eb m\u00eb t\u00eb izoluara. N\u00eb disa qytete ose rajone, mund t\u00eb ket\u00eb norma kulturore m\u00eb t\u00eb forta q\u00eb i dekurajojn\u00eb viktimat t\u00eb raportojn\u00eb dhun\u00ebn n\u00eb familje. Rajonet me fushata m\u00eb t\u00eb mira nd\u00ebrgjegj\u00ebsuese dhe programe arsimore p\u00ebr dhun\u00ebn n\u00eb familje mund t\u00eb ken\u00eb norma m\u00eb t\u00eb larta raportimi, nj\u00ebjt\u00eb dhe p\u00ebr komunat t\u00eb cilat ofrojn\u00eb sh\u00ebrbime m\u00eb diskrete dhe t\u00eb disponueshme p\u00ebr viktimat n\u00eb form\u00eb t\u00eb sh\u00ebrbimeve mb\u00ebshtet\u00ebse. Disa qytete investojn\u00eb m\u00eb shum\u00eb n\u00eb edukimin publik p\u00ebr k\u00ebt\u00eb \u00e7\u00ebshtje, duke i b\u00ebr\u00eb banor\u00ebt m\u00eb t\u00eb prirur t\u00eb raportojn\u00eb incidente. P\u00ebr m\u00eb tep\u00ebr faktori ekonomik i fuqizimit t\u00eb gruas, reagimi ligjor dhe rrjetet mb\u00ebshtet\u00ebse n\u00eb komunitete mund t\u00eb b\u00ebjn\u00eb raportimin m\u00eb t\u00eb qassh\u00ebm. <\/p>\n\n\n\n<p>Besohet q\u00eb k\u00ebta faktor\u00eb nd\u00ebrveprojn\u00eb dhe si rezultat p\u00ebrb\u00ebjn\u00eb variacionet e raportimit. P\u00ebrpjekjet p\u00ebr t\u00eb rritur normat e raportimit dhe p\u00ebr t\u00eb luftuar dhun\u00ebn n\u00eb familje duhet t\u00eb marrin parasysh k\u00ebta faktor\u00eb lokal dhe t\u00eb p\u00ebrshtatin nd\u00ebrhyrjet n\u00eb p\u00ebrputhje me rrethanat. Megjithat\u00eb n\u00eb aspektin e efikasitetit, Prokuroria e Gjilanit ka qen\u00eb me efikasja ku 99% e rasteve t\u00eb trajtuara jan\u00eb zgjidhur. T\u00eb pazgjidhura n\u00eb fund t\u00eb vitit 2022 kan\u00eb mbetur gjithsej 1,487 raste apo 7.17% e l\u00ebnd\u00ebve.<\/p>\n\n\n\n<p>Nd\u00ebrsa nga gjithsej 16,854 kall\u00ebzime penale, n\u00eb fund t\u00eb periudh\u00ebs raportuese jan\u00eb zgjidhur gjithsej 15,253 kall\u00ebzime penale. Numri m\u00eb i madh i kall\u00ebzimeve penale t\u00eb zgjidhura \u00ebsht\u00eb n\u00eb Prokurorin\u00eb e Pej\u00ebs me gjithsej 4,779 raste. Nd\u00ebrsa l\u00ebnd\u00eb t\u00eb pazgjidhura n\u00eb fund t\u00eb vitit 2022 kan\u00eb mbetur 1,334 raste. Kjo pabarazi nxjerr n\u00eb pah nevoj\u00ebn p\u00ebr intervenime t\u00eb ve\u00e7anta dhe kontekstuale por edhe fushata t\u00eb synuara nd\u00ebrgjegj\u00ebsuese n\u00eb rajonet ku raportimi \u00ebsht\u00eb m\u00eb pak i p\u00ebrhapur. P\u00ebr t\u00eb arritur nj\u00eb shoq\u00ebri t\u00eb lir\u00eb nga dhuna n\u00eb familje, \u00ebsht\u00eb thelb\u00ebsore q\u00eb Kosova t\u00eb vazhdoj\u00eb p\u00ebrpjekjet e saj n\u00eb nxitjen e kultur\u00ebs s\u00eb raportimit, sigurimin e mb\u00ebshtetjes p\u00ebr t\u00eb mbijetuarit dhe forcimin e bashk\u00ebpunimit nd\u00ebrmjet institucioneve n\u00eb t\u00eb gjitha nivelet. Vet\u00ebm p\u00ebrmes masave t\u00eb tilla gjith\u00ebp\u00ebrfshir\u00ebse Kosova mund t&#8217;i afrohet q\u00ebllimit t\u00eb \u00e7rr\u00ebnjosjes s\u00eb dhun\u00ebs n\u00eb familje dhe garantimit t\u00eb siguris\u00eb dhe mir\u00ebqenies s\u00eb t\u00eb gjith\u00eb qytetar\u00ebve t\u00eb saj.<\/p>\n\n\n\n<p>Ky shkrim \u00ebsht\u00eb realizuar me p\u00ebrkrahjen financiare t\u00eb Bashkimit Evropian n\u00eb kuad\u00ebr t\u00eb projektit \u201cJUST REACT\u201d.
